In these Terms and Conditions “our”, “us” or “we” mean Chillax Tours & Travel Pty Ltd (CAN: ), “your” or “you” and its assignees and beneficiaries mean the individual, corporation or entity that make use of our bookings or site or contributes in a Tour or activity with us.
The following Terms outline the agreement under which we will provide our Tours to you and you will use our site, services and activities. Please check these Terms carefully. The fact that you use our site or book or participate in any of our Tour or activity, specifies that you have had the opportunity to access these Terms, and that you have read, understood, accepted and will comply with these Terms. We offer this website, including all information, tools and services to you, the user, purchaser or customer, conditioned upon your acceptance of all terms, conditions, policies and notices detailed here and in our privacy police that can be found on our site https://www.chillaxtours.com.
Please read these terms of service cautiously before get into or using our website. By accessing or using any part of the site, you agree to be bound by these terms of service. Section 5 – Accuracy of billing and account information
We stand by the right to refuse any order you place with us. We may, in our sole discretion, limit or withdraw quantities purchased per person, per household and/or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same shipping address and/or billing. In the occurrence that we decide to make a change to or cancel an order, we may attempt to inform you by emailing and/or by phone number or billing address provided at the moment the order was made. We reserve the right to bound or prohibit orders that, in our sole judgment, appear to be placed by resellers, dealers, or unauthorised distributors.
You consent to provide complete, accurate and current information for all purchases made at our different channels. You agree to update your account and other information, including your email address and credit card numbers and expiration dates if there is any change so we can complete your transactions and interact with you as needed.

Section 6 – Payments
The Fees are specified by the Tour or service you have selected throughout the booking process and additionally specified in the Confirmation E-mail we send after the purchase has be done.
Fees are to be paid to us in accordance to the information provide on the booking process that are also specified on the payment terms in our invoices. There is a must to pay the complete Fees prior to the beginning of your Tour. We may cancel your participation in the Tour if the whole Fees are not paid to us in accordance with these Terms and/or the invoice terms.
Our Fees may change from time to time, at our discretion. It is your responsibility to check our current Fees before you to submit your booking.
Section 7 – Prohibited uses
In addition to other legal prohibitions set by the government, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.
We stick to the Creative Commons at any means: Attribution-Non-commercial-No Derivatives 4.0 International (CC BY-NC-ND 4.0) for any content including pictures, text, logos, etc that you may find on our website or other platforms such as Facebook, twitter, Eventbrite, meetup, Spotify, YouTube, among others that belong to Chillax Tours & Travel PTY LTD.
Section 8 – Portal Account- Website
You may register into an account and/or access log in on our Website to retrieve and/or update details of any of your Tours or service purchased. It is your responsibility to keep your account details confidential. You will remain responsible for all activity on your account.
We may grant or refuse you permission to create an account or access to it. We may disable any account or delete any data, at our discretion. We reserve the right to access, monitor and modify your account and the website for maintenance, upgrades and security purposes at any time.
Section 9 – Prices, surcharges and taxes
We will not increase the price of our Tour, activity or service after you have paid in full. Our Tours, activities and services are priced and advertised inclusive of applicable taxes
Now and then we may offer reduced pricing on certain tours, activities or services. Reduced pricing applies only to new bookings. Bookings where payment of at least a deposit has been received by us are not allowed to have a reduced pricing.
Section 10 – Booking process
You may book a Tour or any service from us, using the booking process on our website. We may, at our discretion, accept or reject any booking for any reason. If we accept your booking, a confirmation email will be sent to you, attaching the details, the invoice and a copy of these Terms. It is your own responsibility to check the booking details.
Your booking will be complete, on your payment in accordance with these Terms. Once your booking is complete, you may not cancel your booking other than in accordance with these Terms, including our cancellation policy.
By booking on behalf of other participants, you are considered to be the chosen contact person for each participant included on that booking, so you are liable for making all payments due to your booking, notifying us in case of changes or cancellations are required and keep your party informed. You also represent and agree that you have gotten all compulsory consents. You are accountable for verifying that any data you deliver on behalf of another participant is complete and precise and us will at any means be liable for any mistakes or omissions in the information provided by you.
Section 11 – Transfer of your purchased tour, activity or service
You may not transfer your purchases Tour or service to another party. If you are unable to attend, our cancellation policy will apply. We may allow you to transfer a Tour, or any amounts of the Fees paid by you, to another party, however we will have no obligation to do so, and this allowance will be made in our absolute discretion.
Section 12 – Date changes by the purchaser
We understand that your travel plans might change. Therefore, you must notify us of any desired start date change at least 5 business days prior to the start date of your tour or purchased service. Your request for a start date change will be subject to the availability of your desired New Date. If the New Date is available, and you wish to change the start date of your Tour or purchased service, please see below:
If you notify us more than 14 days prior to the starting date and the date change will be free of charge
If you notify us within 13 to 7 days prior to the starting date of your tour or purchase, you must pay us an administrative fee of 20% of your total purchase, for the reasonable costs incurred by us for the start date change.
If you notify us 7 or less days prior to the starting date, you won’t be entitled to any changes.

Section 13 – Changes in the itinerary by us
The tour or service itinerary may be subject to modifications due to unforeseen conditions or events. We will notify you as soon as possible if we need to cancel or reschedule. If we are incapable to offer a specific inclusion in the tour or service itinerary due to events or conditions beyond our reasonable control, we will use our best endeavours to replace it with an inclusion of equivalent or superior value.
Section 14 – Cancellation and refund policy
Following your payment of part or all of the Fees, if you cancel your Tour and/or service:
If you notify us more than 30 days prior to the date of the event, tour or service, we will refund 100% of your payment, minus credit card fee if applicable.
If you notify us within 29 to 8 days prior to the date of the event, tour or service: You are entitled to 80% refund or to use the option of changing to a different event, tour or service. Subject to the availability and adding the extra cost if applicable. Either way you will incur in $10 AUD charge (per ticket) for administration fees.
7 or less days before the event there won’t be any refund.
Please note that you must notify us in writing and it needs to be emailed to Chillax Tours Australia reservations email: , we also require a receipt or proof of your purchase. We will answer your enquire within 4 business days and if applicable, the refund will be made within 8 business days.
Section 15 – Age and Health
You must be at least 18 years old, or if you are under 18 years old, obtain the consent of your legal guardian and send it to prior to the tour or activity, or during the Tour be under the supervision of a legal guardian that is at least 18 years old. Only when kids are under 4 years old: Parents MUST bring a child chair the day of the tour. Please note that we reserve the right to refuse the entry to the bus if you did not bring a child chair for your kid, and NO refunds will be made in this case.
Participation in our Tours, activities and others may include physical effort and exertion. You must not participate in our tours, activities or others if it will adversely affect your physical health and/or medical condition. We endorse that you seek health advice regarding to your participation. Your participation will be at your own risk.
You are responsible for obtaining any vaccinations or medical information relevant to your destination country.
Section 16 – Passports and visas
You must hold a valid passport for the length of any activity, tour or service booked with us. It is your own responsibility to have a valid visa throughout the duration of the activity, tour or service booked with us. We will not be responsible if you are not allowed to entry to a destination country due to an invalid passport or visa as well as any migration misconduct due to your negligence.
Section 17 – Travel Insurance
We highly recommend holding and maintaining travel insurance when participating in any other Tours. It is your own responsibility to obtain your own travel insurance to cover any responsibility which may be incurred by us or a Service Provider and other travel misfortunes that you wish to be protected against.
Section 18 – Customer's Identification
To be able to confirm that you are the person who are entitles to be part in any of our tours, activities or services, you must carry a valid proof of age ID, Please note that in Australia the only ID forms that are approve are: Australian or Foreign Passport, Australian Driver’s License, Victorian learner permit, Proof of age card or an equivalent from another state or territory of Australia and Key pass card. If you are unable to present any of the previously mentioned ID forms, we can’t guarantee your access to the venue, event, tour, activity or service that you purchased. Also be aware that student cards, copies of Passports and foreign Driver’s licence are not a valid form of identification in Victoria, Australia.
Section 19 – Expected Behaviour
During all out tours, activities and services that we provide, you must cooperate with us, and behave yourself in an suitable, decent, lawful, non-aggressive, non-bullying and appropriate way, and comply with these Terms and any directions or instructions given to you by us or any of our tour guides, at all times.
We may request you to leave a tour or any activity if in our interpretation your conduct is unsuitable. If we request you to leave, you are not entitled to a refund.
You recognise and agree that we are powerless to control the behaviour of you or third parties. You admit and agree that, to the maximum extent permitted by law, we will not be responsible or liable for any misconduct of you or any third party.
Also please note that seat belts must be worn where seat belts are fitted, we do not accept drugs and smoking is not permitted in any of our tours, activities or services.
Section 20 – Bring extra items to our tours and/or activities
You must have a written permission from us by sending us an email or put this down on special needs or notes on the booking process as we must assure that everyone has enough room on the bus/venue/others example: Backpacks, Baby Prams/scrollers, Luggage, big items, among others. IF you do not have our authorisation you will have to leave the item behind.
Section 21 – Service providers
We work to deliver tours, activities and services that meet your expectations. Nevertheless, we take no liability for any matters that came out regarding to or during individual arrangements with specific service providers. We value your feedback, complaints, compliments and/or suggestions but to the extent acceptable by law, we will not be liable to you for any loss, expense or damage that you may have during any particular tour, event, activity or service no matter the cause.
These matters are obligation of each specific service provider and you agree that you will not hold us responsible in any such situations.
Section 22 – Authority on tours, activities and services
Our tours and activities are run by a group leader. The verdict of the group leader is last on all matters likely to affect the protection or well-being of any participant. If you do not comply with a choice made by a group leader or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip instantly, with no right of refund. We might also decide not to let you on any future tour or activity offered by us. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.
Section 23 – Photos and Marketing
You give us your consent to use images of you taken through the tour, activity or service provided for advertising and promotional purposes in any medium we choose. You grant us a licence to use such images for publicity and promotional purposes.
Section 24 – Claims and complaints
In the case that you want to complaint about your experience with us, please inform your group leader (Tours) or our local representative (By asking for the person in charge) at the time so we can attempt to rectify the matter. If you are still not satisfied, then any further complaint should be put in writing to us within 15 days of the end of the tour, activity and/or service provided. You are welcome to send it by post office or by email. Please see our contact details in section 4 - contact us. We are going to give you an answer within 10 business days after you have made your request y/o complaint.
Section 25 – Disclaimer of warranties; limitations of liability
We do not guarantee that your use of our tours, activities or services will be uninterrupted, timely, secure or error-free. You agree that from time to time we may remove some of our tours, activities and/or services for indefinite periods of time without informing you.
You expressly agree that your use of, or inability to use, our tours, activities and/or services is at your own risk. The tours, activities and/or services delivered to you are (except as expressly stated by us) provided ‘as available’ and/or ‘as is’ for you to make use of them, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non- infringement.
In no case shall Chillax Tours Australia , our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of our tours, activities and/or services, or for any other claim related in any way to your use of our tours, activities and/or services, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of our tours, activities and/or services, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

In the event that any provision of these Terms of Service is found to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and conditions also privacy terms, such determination shall not affect the validity and enforceability of any other remaining provisions.
Section 28 – Amendments
We reserve our right to update or change these terms at any time, and will post the amended Terms on our website any amendment will take effect 10 days after being posted to our website. You are deemed to have accepted any amendments to these Terms on the date that is 10 days after their posting on our website. We indorse you to refer to the Terms and conditions prior to the tour, activity and/or service to be familiar with the most up-to-date version available.
Section 29 – Regulatory compliance
This agreement, terms and conditions will be governed by and interpreted in accordance with the laws of Victoria, Australia to the fullest extent allowable. Any disputes in connection with a tour, activity or service provided must be initiated in the courts of Victoria, Australia. We also comply with the Australian Consumer Law and Fair Regulations. You irrevocably submit to the exclusive jurisdiction of the courts of the State of Victoria, Australia.
